ANSR Litigation Support

As an extension of ANSR Dispute Representation, ANSR can remain or become involved after legal proceedings have commenced.

Where ANSR has represented clients during earlier dispute resolutions processes, it may be in the interests of clients that ANSR remain involved or be reintroduced after proceedings have been commenced to avoid a duplication of effort, time and costs. This will enable recently introduced advisors to draw on matter-specific work and knowledge of ANSR to advance a client’s interests during the course of the proceedings.

This collaborative approach will also allow ANSR to be involved in settlement discussions and negotiations where it has become common practice for Courts and tribunals across all jurisdictions and areas of the law to require parties to participate in dispute resolution processes, including mediation, before allowing legal proceedings to progress towards trial.

It is in this context that ANSR may also be introduced to a client or matter for the first time, primarily to work with clients and their existing advisors to develop and apply dispute resolution strategies during settlement discussions and any formal dispute resolution process that will inevitably take place after legal action has been commenced.

It may also become necessary for ANSR to recommend to clients that legal proceedings be commenced before initiating settlement discussions or proceeding to mediation where Court orders are required to protect the interests of clients, including to secure assets, maintain the status quo, seek the disclosure of relevant information or to simply compel others to cooperate.

This will only be recommended by ANSR where commencing legal proceedings and the seeking of Court orders is necessary to protect the interests of clients, and where doing so will enable clients to become fully informed and properly prepare for any attempts at settlement, including mediation.

ANSR has longstanding relationships with specialist litigation solicitors and barristers that can be recommended to clients where legal proceedings and the seeking of Court orders becomes necessary. ANSR can then work alongside those advisors in achieving commercial and interests-focussed outcomes for clients.
